Terms of Use

These Terms of Use (‘Terms’) constitute a legal agreement governing your use of the Monogam mobile application (‘Application’) and concluded between you and Taha Dülgar in the capacity of service provider. By downloading, registering for, or using the Application, you are deemed to have accepted these Terms. These Terms apply together with our Privacy Policy and KVKK Disclosure Notice. Monogam is intended solely for users aged 18 and over.

1. Account Creation and Security

To use Monogam, you must create an account. When creating an account:

• You must enter your real name, date of birth, and other information accurately and completely
• You must verify your phone number and email address via OTP
• You may not use another person’s account or share your account with others
• You are responsible for the security of your account; keep your password confidential

You are fully responsible for the accuracy of the information you provide. If it is determined that false information has been provided, your account may be suspended or terminated.

2. Scope of the Service

2.1 Services Provided

Monogam provides the following services:

• Algorithmic matching and user recommendation system
• Messaging between matched users
• Profile creation and editing
• At least one profile photo (optionally up to 5 photos may be uploaded; this maximum limit may be changed unilaterally by Monogam from time to time.)
• ‘Get a Question’ feature: Opens a random question on the messaging screen allowing both users to optionally respond; questions cover lifestyle, personal preferences, dating, and general topics
• Premium subscription and in-app purchases

2.2 Service Changes

Monogam reserves the right to change its features, pricing, and scope of service. Material changes will be communicated via in-app notification or email.

3. User Content

3.1 Content Responsibility

You are fully responsible for all content you upload or share in the Application (‘User Content’). User Content includes: profile photos, bio text, prompt responses, responses to the ‘Get a Question’ feature, messages, and other shares.

3.2 Content License

By uploading content to the Application, you grant Monogam a non-exclusive, worldwide, royalty-free license to use, display, copy, and distribute such content for the purpose of providing the service. This license is valid solely for the operation of the service; your content will not be used for advertising purposes. This license terminates when you delete your account; however, a limited right for technical processing remains reserved for the retention periods specified in our Privacy Policy.

3.3 Prohibited Content

You may not upload or share the following content:

• Photos and information that are untrue, misleading, or belonging to another person
• Sexually explicit or nude content
• Materials containing violence, hate speech, or discrimination
• Messages containing harassment, bullying, or threats
• Advertising, spam, or commercial promotional content
• Materials that infringe intellectual property rights
• Content that encourages illegal activities
• Materials involving persons under the age of 18

Monogam reserves the right to remove content that violates these rules without prior notice.

4. User Conduct Rules

When using the Application, you must comply with the following rules:

• Act under your real identity; do not create fake profiles
• Treat other users with respect
• Do not share other users’ personal information without permission
• Use the Application solely for individual, non-commercial purposes
• Do not scrape or copy application data using automated systems, bots, or software
• Do not engage in attempts that would threaten the security of the Application

Your conduct outside the Application may also result in action being taken against your account. If reliable information is obtained that you have harmed other users, Monogam may suspend your account.

5. Account Suspension, Restriction, and Termination

5.1 Monogam’s Rights

Monogam may warn, restrict, suspend, or terminate your account without prior notice in the following circumstances:

• You violate these Terms
• You upload or share prohibited content
• You engage in harmful behavior toward other users
• It is determined that you have created a fake profile
• You threaten the security of the Application
• At the request of competent authorities

5.2 Appeal Process

If you believe that an action taken against your account was erroneous, you have the right to appeal within 30 days from the date of the action. You may submit your appeal through the following channels:

• In-app: Profile > Support > Account Appeal

Your appeal will be reviewed within 14 business days and the outcome will be communicated to you. During the appeal process, access to your account may remain restricted. If your appeal is rejected, you retain the right to apply to the Consumer Courts.

5.3 Account Deletion

You may delete your account at any time via Profile > Settings > Delete Account. Deleting your account does not automatically cancel your subscription. You must separately cancel any active subscription.

6. Payment and Subscription Terms

6.1 General

In addition to the free basic service, Monogam offers paid subscription options for premium features. Subscriptions are purchased through the Apple App Store or Google Play Store and managed via RevenueCat.

6.2 Auto-Renewal

Subscriptions automatically renew at the end of the period unless you cancel, and payment will be charged to your payment method. To avoid being charged for a new period, you must cancel at least 24 hours before the subscription period ends.

6.3 Price Changes

Monogam reserves the right to change subscription prices. You will be notified before a price change. If you do not cancel the subscription after notification, you will be deemed to have accepted the new price.

6.4 Cancellation

You may cancel your subscription through the platform from which you purchased it:

• Purchases via Apple App Store: App Store > Apple ID > Subscriptions
• Purchases via Google Play: Google Play > Subscriptions

Cancellation takes effect at the end of the current period; you retain access to the service for the remaining time.

6.5 Refunds

As a general rule, completed payments are non-refundable. Digital content and subscription services that are performed immediately in an electronic environment are legally outside the scope of the right of withdrawal. In-app purchases are deemed performed at the moment of approval and are, as a rule, non-refundable. However, you may request a refund in the following cases:

• Under the Turkish Consumer Law, where the service is not provided at all or is provided defectively
• Requests under Apple’s or Google’s own refund policies must be made directly through the relevant platform

If your account is terminated under these Terms, fees paid will not be refunded.

7. Intellectual Property

The Monogam brand, logo, design, software, and all other content belong to Monogam and are protected by copyright, trademark law, and other applicable legal regulations. You are granted only a personal, non-exclusive, non-transferable, and limited license to use within the framework of these Terms. Reverse engineering, copying, distributing, or using the Application or its contents for commercial purposes is prohibited.

8. Disclaimer and Limitation of Liability

8.1 Service Warranty

Monogam does not warrant that the service will be uninterrupted, error-free, or fit for a particular purpose. The service is provided ‘as is’.

8.2 User Interactions

Monogam is not responsible for users’ interactions with one another. Meetings or communications you undertake with other users in real life are entirely your own responsibility.

8.3 Limitation of Liability

To the maximum extent permitted by applicable Turkish law, and subject to cases of gross negligence or willful misconduct remaining reserved, our liability arising from any damage shall not exceed the subscription fees you have paid in the last 12 months.

9. Indemnification

You agree to indemnify Monogam against third-party claims, lawsuits, or damages directed at Monogam arising from your breach of these Terms, sharing of prohibited content, or harm caused to other users.

10. Dispute Resolution

10.1 Governing Law

These Terms are subject to Turkish law. For disputes within the scope of consumer rights, the Consumer Courts and Consumer Arbitration Committees in Turkey have jurisdiction.

10.2 Negotiation First

In the event of any dispute, amicable resolution shall first be sought within 30 days by sending written notice to [[email protected]].

11. Privacy

The processing of your personal data is governed by our Privacy Policy and KVKK Disclosure Notice. These documents form an integral part of these Terms.

12. Changes to the Terms

Monogam may update these Terms from time to time. Material changes will be communicated to you via in-app notification or email. Continuing to use the Application after a change means that you accept the new Terms. If you do not accept the new Terms, you may delete your account.

13. Miscellaneous Provisions

If any provision of these Terms is held to be invalid, the validity of the remaining provisions shall not be affected. Monogam’s failure to exercise any right does not constitute a waiver of that right.
