Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Monotech Bilişim Teknoloji Anonim Şirketi (Tax No: 6211334496, MERSIS No: 0621133449600001), as service provider, governing your use of the Monogam mobile app (the “App”). By downloading, registering for or using the App, you are deemed to have accepted these Terms. These Terms apply together with our Privacy Policy and our PDPL Privacy Notice (KVKK).

Monogam is intended only for users aged 18 and over.

1. Account Creation and Security

You need to create an account to use Monogam. When creating an account:

You are fully responsible for the accuracy of the information you provide. If it is determined that false information has been provided, your account may be suspended or terminated.

Monogam reserves the right to change its features, pricing and scope of service. Material changes are communicated via in-app notification or email.

3. User Content

3.1 Responsibility for Content

You are fully responsible for any content you upload to or share on the App (“User Content”). User Content includes: profile photos, bio text, prompt answers, answers given to the “Get a Question” feature, messages and other posts.

3.2 Content License

By uploading content to the App, you grant Monogam a non-exclusive, worldwide, royalty-free license to use, display, copy and distribute that content for the purpose of providing the service. This license applies only to the operation of the service; your content is not used for advertising purposes. This license ends when you delete your account; however, a limited right for technical processing is retained for the retention periods specified in our Privacy Policy.

Monogam reserves the right to remove content that violates these rules without prior notice.

4. User Conduct Rules

While using the App, you must comply with the following rules:

Your conduct outside the App may also result in action being taken on your account. Monogam may suspend your account if it obtains credible information that you have harmed other users.

5. Account Suspension, Restriction and Termination

5.1 Monogam’s Rights

Monogam may warn, restrict, suspend or terminate your account without prior notice in the following cases:

If you believe an action taken against your account was in error, you have the right to appeal within 30 days of the date of the action. You may submit your appeal through the following channel:

Your appeal will be reviewed within 14 business days and you will be notified of the outcome. Access to your account may remain restricted during the appeal process. If your appeal is rejected, you retain the right to apply to the Consumer Courts.

5.3 Account Deletion

You can delete your account at any time from Profile > Settings > Delete Account. Deleting your account does not automatically cancel your subscription. You must cancel your active subscription separately.

6. Payment and Subscription Terms

6.1 General

In addition to its free core service, Monogam offers paid subscription options for premium features. Subscriptions are purchased through the Apple App Store or Google Play Store and managed via RevenueCat.

6.2 Automatic Renewal

Unless you cancel, subscriptions automatically renew at the end of the period and your payment method is charged. To avoid being charged for a new period, you must cancel at least 24 hours before the end of the subscription period.

6.3 Price Changes

Monogam reserves the right to change subscription prices. You will be notified before any price change. If you do not cancel your subscription after the notification, you are deemed to have accepted the new price.

6.4 Cancellation

You can cancel your subscription through the platform where you purchased it:

Cancellation takes effect at the end of the current period; your access to the service continues for the remaining time.

6.5 Refunds

As a general rule, completed payments are not refunded. Digital content and subscription services performed instantly in electronic form are legally excluded from the right of withdrawal. In-app purchases are deemed performed as soon as they are confirmed and, as a rule, are not refunded. However, you may request a refund in the following cases:

If your account is terminated under these Terms, fees paid will not be refunded.

7. Intellectual Property

The Monogam brand, logo, design, software and all other content belong to Monogam and are protected by copyright, trademark law and other relevant legal regulations. You are granted only a personal, non-exclusive, non-transferable and limited license to use the App within the framework of these Terms.

Reverse engineering, copying, distributing or using the App or its content for commercial purposes is prohibited.

8. Disclaimer and Limitation of Liability

8.1 Service Warranty

Monogam does not guarantee that the service will be uninterrupted, error-free or fit for a particular purpose. The service is provided “as is”.

8.2 User Interactions

Monogam is not responsible for users’ interactions with one another. Any real-life meetings or communications with other users are entirely at your own risk.

8.3 Limitation of Liability

To the maximum extent permitted by applicable Turkish law, and without prejudice to cases of gross negligence or intent, our liability arising from any damage shall not exceed the subscription fees you have paid in the last 12 months.

9. Indemnification

You agree to indemnify Monogam for any third-party claims, lawsuits or damages brought against Monogam as a result of your violation of these Terms, sharing of prohibited content or harm caused to other users.

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by Turkish law. For disputes within the scope of consumer rights, the Consumer Courts and Consumer Arbitration Committees in Türkiye have jurisdiction.

10.2 Negotiation First

In the event of any dispute, an amicable resolution will first be sought within 30 days by sending a written notice to [email protected].

11. Privacy

The processing of your personal data is governed by our Privacy Policy and our PDPL Privacy Notice (KVKK). These documents form an integral part of these Terms.

12. Changes to the Terms

Monogam may update these Terms from time to time. Material changes are communicated to you via in-app notification or email. Continuing to use the App after a change means you accept the new Terms. If you do not accept the new Terms, you may delete your account.

13. Miscellaneous

If any provision of these Terms is held invalid, this does not affect the validity of the other provisions. Monogam’s failure to exercise any right does not constitute a waiver of that right.
